JOE CAVES: Biden Withdraws Vax Mandate on Private Businesses After Losing in Court

The White House officially withdrew its vaccine mandate on private businesses with 100 or more employees Tuesday after the order was blocked by the United States Supreme Court.

“Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,” the court wrote in an unsigned opinion.

“The federal government respectfully moves to dismiss the petitions challenging the Vaccination and Testing emergency temporary standard (Vaccination and Testing ETS) issued by the Occupational Safety and Health Administration (OSHA) to address the grave danger of COVID-19 in the workplace,” the Biden administration stated.

The “Department of Labor’s [OSHA] is withdrawing the vaccination and testing emergency temporary standard issued on Nov. 5, 2021, to protect unvaccinated employees of large employers with 100 or more employees from workplace exposure to coronavirus,” OSHA said in a statement.
